This role
The Legal Analyst role at Pay Joy exists to manage and resolve legal disputes efficiently, minimizing financial exposure and protecting the company’s interests. This role is essential in handling litigation, particularly in complex legal environments like Brazil, where ongoing regulatory challenges and customer or partner claims are prevalent. In addition to defending the company in court or arbitration, the attorney proactively seeks favorable settlements to avoid prolonged legal battles and reduce costs. By strategically negotiating settlements, the role helps save money and resources while minimizing disruptions to busines operations, ultimately contributing to the company's financial stability and legal compliance.
Responsibilities:
- Manage Ongoing Litigation What: Oversee and manage all ongoing litigation cases involving the company. How: Collaborate with external counsel and internal teams to prepare legal strategies, gather evidence, and ensure timely court filings. Why: To ensure Pay Joy’s legal defenses are robust, aligned with business objectives, and mitigate potential risks.
- Negotiate Settlements What: Seek opportunities to settle disputes out of court when financially advantageous. How: Use negotiation skills to work with opposing parties to reach favorable settlements. Why: To save the company time, resources, and money by avoiding prolonged litigation.
- Ensure Compliance with Local Laws and Regulations What: Ensure the company’s actions in litigation are compliant with local laws, particularly in Brazil. How: Stay updated on regulatory changes and legal precedents, applying this knowledge to active cases. Why: To avoid penalties or unfavorable rulings due to non-compliance with jurisdiction-specific regulations.
- Provide Legal Risk Assessments What: Evaluate potential and ongoing cases to provide detailed legal risk assessments to senior management. How: Analyze case merits, legal precedents, and potential outcomes to offer informed recommendations. Why: To enable the company to make strategic decisions based on legal risk exposure and potential financial impact.
- Coordinate with Internal Teams What: Work closely with internal teams (such as compliance, risk, and product teams) to ensure legal strategies are aligned with business operations. How: Provide legal guidance, review documents, and advise on risks for business decisions that could lead to litigation. Why: To ensure that all departments operate within legal limits and minimize the chances of future disputes.
- Manage Relationships with External Counsel What: Oversee and collaborate with external law firms on high-stakes or complex litigation. How: Communicate Pay Joy’s objectives clearly to external counsel and ensure their strategies align with the company's goals. Why: To ensure effective legal representation that serves Pay Joy’s best interests.
- Draft and Review Legal Documents What: Draft, review, and approve legal documents related to litigation, settlements, and disputes. How: Carefully assess contracts, pleadings, and other legal materials to ensure they are legally sound and protect the company. Why: To safeguard Pay Joy’s legal position and reduce the risk of unfavorable terms or outcomes.
- Prepare and Present Litigation Reports What: Provide regular updates and reports on litigation status and potential outcomes to senior leadership. How: Summarize case progress, key risks, and strategic recommendations in concise and actionable reports. Why: To keep leadership informed and enable strategic decision-making based on current legal challenges.
Requirements:
- Juris Doctor (JD) or Equivalent Law Degree: A recognized law degree and admission to the bar in the relevant jurisdiction, particularly in Brazil or other applicable regions where Pay Joy operates.
- 5+ Years of Litigation Experience: Proven track record of at least 5 years managing litigation, including commercial, regulatory, or civil disputes, preferably within regulated industries.
- Experience in Negotiating Settlements: Demonstrated expertise in negotiating and closing settlements that minimize financial exposure and reduce the duration of legal disputes.
- Knowledge of Brazilian Legal and Regulatory Frameworks: In-depth understanding of Brazilian legal systems and regulations, particularly regarding financial services, consumer protection, and data privacy, to ensure compliance and effective case management.
- Proficiency in Legal Research and Case Management Software: Advanced user skills in legal research platforms (e.g., Projuris, Tedesco) and case management software to efficiently manage and track litigation progress and research case precedents.
