PROJECT BACKGROUND
One of the key aspects of GGGI's green growth policy in the energy sector is the development of a sustainable energy policy framework and the promotion of renewable energy projects. Since 2020, GGGI has supported Min Energia, the Institute for Planning and Promotion of Energy Solutions for Non-Interconnected Areas (IPSE) and selected private sector developers to advance Colombia's energy transition and provide sustainable and affordable energy solutions to vulnerable rural communities and households. This technical assistance was funded by the UK Government's Department for Business, Energy and Industrial Strategy through the UKPACT program.
In May 2024, GGGI was awarded by the Mitigation Action Facility Fund to develop the detailed project preparation of the "Sustainable Power and Resilience for Colombia's Energy Communities" project. This initiative, currently in the detailed project preparation phase, is funded by the Mitigation Action Facility Fund (MAF, formerly the Nama Facility) and focuses on capacity building and the development of financial instruments for small-scale distributed energy systems called Energy Communities (ECs).
OBJECTIVES OF THE ASSIGNMENT
DELIVERABLES AND PAYMENT SCHEDULE
a) Prepare a Work Plan of the activities in coordination with relevant stakeholders to undertake under the assignment tied to the objectives of the assignment mentioned above. The Work Plan should include a timeline of main activities, methodology, milestones, validation meetings with GGGI, and description of final deliverables. The Work Plan should include the scheduling of meetings with the relevant stakeholders and their respective legal teams.
b)Read and revise documents relevant to the "Sustainable Power and Resilience for Colombia's Energy Communities" project and the financial instruments proposed. The consultant will be asked to produce technical legal executive summary reports and Power Point presentations for GGGI project team, based on the documentation shared with the consultant.
Deliverable 2: Legal Advisory on business models and Financing Mechanisms
a) Advisory on Business models: Provide expert legal and technical advice on the establishment and operation of Energy communities proposed under the"Sustainable Power and Resilience for Colombia's Energy Communities" project, especially in the models with investment and ownership by private Energy Service Companies (ESCos).
b)Advisory on Financing Mechanism: Provide expert legal and technical advice on the establishment and operation of the financing mechanism and its associated financial products proposed under the "Sustainable Power and Resilience for Colombia's Energy Communities" project, namely a Project Preparation Facility and a guarantee Fund, to support the roll-out of the Energy Communities program.
c)Risk Mitigation Strategy: Develop a strategy for mitigating legal and regulatory risks associated with the proposed business models and financing mechanisms, ensuring compliance with national regulations.
d) Drafting Legal Documents: Assist in drafting necessary legal documents and agreements required to operationalize the business models and financing mechanism, including terms of reference for financial instruments, contracts, and stakeholder agreements.
e)Report: Legal and Business Development Analysis report on the "Sustainable Power and Resilience for Colombia's Energy Communities" project
Deliverable 3: Regulatory Assessment and Intervention Design
a)Detailed Regulatory Assessment: Undertake a detailed assessment of the current regulatory environment impacting the development and operation of ECs in Colombia. This includes identifying gaps, barriers, and opportunities for regulatory intervention, including processes and standards that will facilitate the development, implementation, and scaling of ECs.
b) Design of Regulatory Interventions: Development of detail roadmap for implementation of identified regulatory intervention under the "Sustainable Power and Resilience for Colombia's Energy Communities" project, recommending the timelines, roles, and responsibilities for project staff and stakeholders for its implementation.
c) Stakeholder Engagement: Engage with relevant stakeholders, including government agencies, regulatory bodies, and private sector entities, to validate proposed regulatory interventions and ensure alignment with national energy goals.
d)Report: Systematize all collected information, annexes, meeting minutes, etc. and consolidate it in a Regulatory Assessment Report.
Deliverable 4: Energy Policy enhancement
a)Policy Analysis: Analyze existing energy policies and permits relevant to ECs, identifying areas that require reform or enhancement to support the widespread adoption of ECs.
b) Policy enhancement plan: in collaboration with government partners, prepare a detailed permit and policy enhancement plan, outlining necessary legislative and regulatory changes, the timeline for implementation, and roles and responsibilities of key stakeholders.
c) Implementation Roadmap: Develop a roadmap for implementing the permit and policy reform plan, including steps for stakeholder consultation, legislative drafting, and approval processes.

METHODOLOGY AND REPORTING ARRANGEMENTS
- The consultant's work progress will be monitored primarily through periodic review meetings for planning, and weekly meetings for prioritizing activities, all of them previous consensus with the Contract Supervisor, GGGI. These review meetings will tackle subjects such as the overview of the contractual objectives, the development of activities, detailed information milestones, actual achievements made against the timeline initially set, and any other relevant progress details.
- Supervision shall be provided by the Project Manager of GGGI with additional orientation by GGGI Regional Energy Lead, the GGGI Regional investment officers in order to ensure the timely and quality delivery of products outlined in the contractual objective.
- The Energy Directorate at the Ministry of Mines and Energy may provide inputs to the consultant as per GGGI request. The final review and approval of deliverables under the contract is to be made by the supervisor from GGGI Colombia.
- All final reports or outputs must be written in Spanish and approved by GGGI, and subsequent English translation submitted before payment is released. Submissions must be following GGGI’s formatting requirements and be submitted with proof of editable file back-up (e.g. .docx, .xlsx, .pptx) in an external hard disk and GGGI Share Point system . Where relevant, the consultant shall also provide sets of raw data, research materials, and meeting notes related to the contractual objective.
- The Consultant shall submit the Final Report which should reflect the outcome of all activities prepared by the consultant. The report should also give recommendations for further activities to be carried out in order to secure a long-term sustainable development of the measure and must be approved by the GGGI. The Consultant shall consider the comments and necessary revisions proposed. Within 14 days from the receipt of the comments or modification proposal from the GGGI, the Consultant shall prepare and submit the final versions of the report. All relevant technical papers, reports, and other documents prepared from the start to the end of the assignment shall be attached to the Final Report.
EXPERTISE REQUIRED
- (MANDATORY) Must be a Colombian citizen, or a foreigner holding a valid Work Visa.
- (MANDATORY) A professional with a degree in Law or Economics, industrial engineering or related field with a post-graduate qualification in energy regulation, energy policy, public law, commercial law, financial law, economics or a related field.
- (MANDATORY) Minimum five (5) years of professional experience in public and/or private organizations in economic affairs and regulatory drafting, and/or legal advisory in the energy sector, including significant experience in renewable energy projects, and state contracting in energy law.
- (MANDATORY) Knowledge of the Energy Policy in Colombia
- (DESIRABLE) Experience in financial regulation.
- Proficiency in Microsoft Office applications (Word, Excel, Power Point, etc.)
- Exceptional analytical and quantitative skills; capacity for synthesis, presentation, and communication; and strategic thinking skills
- Organized with excellent time management and attention to detail.
- Strong and matured interpersonal skills and proven ability to work with teams.
- Ability to work well under pressure and have a flexible approach to tasks given.
- Strong command of spoken and written English and Spanish.
