Introduction


The Department of Health Services (DHS), Division of Public Health (DPH) works with our local and tribal public health partners, and community groups statewide, on a wide variety of programs and services that protect the health of Wisconsin residents.
DPH is recruiting for a Tobacco Enforcement Specialist in the Bureau of Community Health Promotion (BCHP).
This position offers the option to work remotely up to 5 days per week and will be headquartered at the DPH regional offices in Milwaukee or Waukesha. The position will travel approximately 90% of the time including overnight travel. The majority of the travel will be throughout southeastern Wisconsin.

Position Summary

As the Tobacco Enforcement Specialist, you will be responsible for supporting the Food & Drug Administration (FDA) State Program Coordinator and Underage Purchasers in conducting investigations to support the FDA in enforcing the Family Smoking Prevention and Tobacco Control Act with respect to tobacco retail establishments. Duties include:
  • Assisting in the recruitment, orientation and training of Underage Purchasers.
  • Coordinating and working with Underage Purchasers to complete FDA Undercover Buy inspections.
  • Conducting Advertising and Labeling inspections in tobacco retail establishments that sell and advertise tobacco and nicotine products to determine compliance with federal law.
  • Collecting all required information during tobacco retailer investigations.
  • Generating and submitting observations and inspection results to FDA and State Program Coordinator for review.
  • Preserving evidence according to FDA guidelines.
  • Supporting FDA in any enforcement or judicial actions.
Salary Information

The starting pay is between $25.00 and $34.00 per hour (approximately between $52,000 and $70,700 per year), depending on qualifications, plus excellent benefits. A 12-month probationary period is required.
Pay for current or former state employees will be set based on the rules that apply to compensation for the applicable transaction. The position is in the Regulatory Specialist classification and is in pay schedule and range 07/04.
Job Details
  • All applicants who may be appointed will be required to allow DHS to conduct a background check to determine whether the circumstances of any conviction may be related to the job being filled.
  • The candidate hired for this position will be required to become a federally commissioned officer by the FDA. This includes but is not limited to:
  • Clearing criminal and federal background checks (including fingerprinting).
  • Completing all commissioning paperwork required by the FDA.
  • Not having significant financial interests in any company that the person inspects or whose compliance information and/or evidence the person is responsible for gathering, maintaining or reporting.

  • DHS does not sponsor work visas for this position, thus, in compliance with federal law, selected candidates will be required to verify eligibility to work in the United States by completing the required I-9 form upon hire.
  • For positions that allow remote working flexibility, working outside of Wisconsin or in bordering cities will not be allowed except in extremely limited circumstances due to the need to report to an office location in Wisconsin on short notice.
  • Employees must have access to both a private workspace and secure high-speed internet for remote work option. Mileage reimbursement to the employee’s headquarter location is not provided. Remote work flexibility will be discussed in more detail during the interview process.
  • This position requires the ability to drive a State vehicle or the ability to provide one's own transportation. In order to become authorized to drive a State vehicle, you must meet the requirements of the State of Wisconsin Fleet Vehicle Policy.
Qualifications

Minimally qualified applicants will have all of the following:
  • Experience conducting inspections or investigations, including writing reports.
  • Experience providing training or technical assistance to others.
  • Experience with FDA programs or procedures.
Well-qualified applicants will also have one or more of the following:
  • Experience with the recruitment, orientation, or training of youth or young adults.
  • Experience with commercial tobacco prevention or enforcement.
  • Experience guiding the work of youth or adults in remote field inspections and providing them with constructive program guidance.
