Legal & Compliance Specialist

MMC Taiwan LCPA ( Legal, Compliance & Public Affairs ) Team is seeking candidates for the following position based in Taipei office:

Legal & Compliance Specialist - Marsh Mercer Taiwan, Legal, Compliance & Public Affairs

The Legal & Compliance (L&C) Specialist will report to the Taiwan Chief Counsel. The primary role is to assist the Chief Counsel with a variety of legal and compliance functions, while being able to handle certain tasks independently. This role also has responsibility for collaborating with the businesses to understand the business environment and strategy in order to advise and provide guidance on potential risks. The L&C Specialist will ensure compliance of Marsh Mercer with applicable law/regulation. He/she will implement Marsh Mercer legal and compliance strategy, processes and goals in the operations in Taiwan.

We will count on you to:
  • Provide analysis and counsel on a range of legal and compliance issues, including commercial and corporate issues, digital and data privacy, anti-bribery and corruption, AML and trade sanctions, fair trade and competition, business structures and models, property related, employment, insurance and reinsurance under Taiwan law
  • Draft, review and negotiate contracts and related documents for the procurement or provision of goods and services, confidentiality of proprietary information, employment, leases of space and equipment, and software licenses
  • Assist with regulatory advisory work under Taiwan law
  • Anticipate and identify compliance issues in Taiwan of concern to the business and develop compliance strategies and solutions
  • Analyse a broad range of local laws and regulations in affecting the operations of the Company including those arising from corporate structures and business models
  • Manage Cyber and Data Privacy controls, manage data incidents and reporting
  • Monitor colleague participation and execution of compliance standards in the areas of anti-competition, gifts and entertainment, anti-money laundering, sanctions, Client First Principles, client service agreements, errors & omissions (E&O) and other legal / compliance policies and topics
  • Assist with and review all Third Party Provider (TPP) submissions, renewals and payments for compliance with company policy and procedure, including timeliness of submissions and renewals, prior to TPP engagement
  • Review regulations / directives and global / regional policies and explain their requirements and applicability to the Taiwan colleagues and operations
  • Develop procedures, processes and policies to support the legal and compliance function, in conjunction with all internal and external standards and regulations. Support with training, communications and monitoring in Taiwan
  • Manage internal investigations until conclusion and make related recommendations to the relevant committees for consequences of potential non-compliance based on facts identified through the investigation process
  • Ensure effective processes exist to address E&O prevention and mitigation. Triaging, investigating, mitigating, and closing E&O claims as well as assisting in reviewing claims history, identifying trends, and developing awareness education to avoid repeatable incidents
  • Advise the business on the status of compliance, transparency, and overall professional liability performance of colleagues
  • Work closely with internal business functions of finance, human resources in relation to reviewing business practices / corporate structures, developing and maintaining compliance controls, training and investigations
  • Support and implement global / regional legal and compliance efforts for the Company and promote an ethical and legally compliant business culture
  • Conduct compliance training for colleagues
  • Manage company secretary responsibilities, which include matters relating to the Board and corporate governance

What you need to have:
  • Law degree required (5+ year work experience)
  • Admission to the Taiwan bar is a plus
  • Fluent in English (Professional-level English speaking and writing required)
  • Experience in compliance management and working in-house with a multi-national company
  • Familiar with regulatory advisory work, preferably in insurance or other financial services sectors
  • Solid working knowledge on contract reviews, drafting and negotiation
  • Ability to analyze complex compliance, regulatory and/or legal problems and exercise good judgment even in ambiguous situations
  • Attention to details and good communication and problem-solving skills
  • Strong sense of ownership and responsibility
