Senior Lawyer, Lawyer, Accountant/Finance Analyst

The team 
ASIC's Enforcement and Compliance Group (ECG) is responsible for the conduct of ASIC's initial inquiries, compliance and enforcement work across all sectors excluding markets.
ECG's newly created Greenwashing and Environment, Social and Governance team will focus on deterring misconduct through enforcement activities. Greenwashing and sustainable finance are key priorities for ASIC. ASIC is focusing on supporting market integrity and efficiency through the supervision and enforcement of current governance, disclosure and conduct laws to reduce harms from greenwashing.
ASIC recognises the crucial role that Australian businesses and asset managers will play in helping to facilitate Australia's transition to net zero and the mobilisation of private capital to achieve this goal. Investors can only make financial decisions based on the information available to them, which is why it is important that entities are prepared to disclose to the market the business plans and sustainability-related strategies they are pursuing. It is equally important that these disclosures, when made, are well founded, transparent and consistent with the actions being taken by the entity. While the landscape for sustainability-related disclosures in Australia is undergoing significant change, ASIC remains focused on supporting market integrity. This includes taking enforcement action.

The roles
As part of the team you will be accountable to:

  • manage and/or contribute to large complex investigations of suspected misconduct into greenwashing and ESG misconduct.
  • utilise technology to analyse data, information and documentation in order to identify and present relevant evidence that actively progresses investigations.
  • employ a range of evidence gathering techniques including conducting examinations, interviewing witnesses, taking complex statements and undertaking document review using electronic tools.
  • identify issues including complex legal issues arising in investigations. 
  • support ASIC Litigation Counsel in commencing and conducting civil litigation in the Supreme and/ or Federal Courts, including briefing and instructing Counsel
  • communicate with external parties in relation to issues arising during the course of the investigation.
 Please note that roles are available at the ASIC 4, EL1 and EL2 classifications

  • ASIC4 – from $90,749 + 15.4% superannuation: candidates with minimum 3-5 years relevant experience.
  • EL1 – from $118,925 + 15.4% superannuation: candidates with minimum 5-6- years relevant experience.
  • EL2 – from $141,690 + 15.4% superannuation: candidates with minimum 7+ years relevant experience.

About you 

  • A relevant tertiary qualification including in law, commerce, accounting, finance, data science or other relevant discipline.
  • Experience in a role that involved investigation, case management, evidence gathering processes, project management or detection of misconduct, including the conduct of civil litigation and/or the preparation of criminal briefs of evidence. 
  • Ability to plan, deliver and manage complex investigations through to completion.
  • For lawyers, experience in conducting complex civil litigation.
  • Understanding of the law, practice and policy relating to the Corporations Act, the National Consumer Credit regime, the ASIC Act and other relevant financial services legislation. 
  • Strong legislative and evidence analysis skills. 
  • Highly developed writing and drafting skills, and the ability to communicate verbally in a clear, concise and persuasive manner. 
  • Demonstrated ability to use digital investigative tools. 
  • Confidence presenting, building rapport, interviewing, and advocating an organisation's position in the context of complex issues. 
  • Experience in sustainable finance, climate change adaptation and/or mitigation, sustainability and/or climate change related reporting, ESG analytics and/or sustainability assurance is desirable but not mandatory.
